DMCA and Copyright Policy

This DMCA and Copyright Policy (the "Policy") describes how Compozly, LLC ("Compozly," "we," "us," or "our") responds to claims of copyright infringement and other intellectual property concerns relating to content available on Compozly.com and related services (collectively, the "Service"). This Policy is incorporated into and forms part of Compozly's Terms of Service.
1. Overview
Compozly respects the intellectual property rights of others and expects users to do the same. It is Compozly's policy to:
- Remove or disable access to content upon receipt of a valid copyright notice that complies with the Digital Millennium Copyright Act ("DMCA").
- Terminate accounts of repeat infringers in appropriate circumstances.
- Provide a counter-notice process for users who believe their content was removed due to mistake or misidentification.

3. How to Submit a DMCA Takedown Notice
If you believe that content on the Service infringes your copyright, you may submit a written DMCA notice (a "Notification of Claimed Infringement") to Compozly's Designated Agent. Your notice must include the following information:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notice, a representative list of such works.
- Identification of the material claimed to be infringing, and information reasonably sufficient to permit Compozly to locate the material on the Service (for example, the specific URL(s) and screenshots if available).
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Compozly may request additional information to process your notice.
4. What Happens After We Receive a Valid Notice
Upon receipt of a valid DMCA notice, Compozly may, in its discretion:
- Remove or disable access to the allegedly infringing material.
- Notify the user who uploaded or posted the material ("Uploader") that we removed or disabled access to the material.
- Record the notice for repeat infringer tracking and enforcement.
Compozly reserves the right to remove or restrict content for any reason consistent with our Terms of Service.
5. Counter-Notification Process
If you are an Uploader and you believe content you posted was removed or disabled due to mistake or misidentification, you may submit a counter-notification ("Counter Notification") to Compozly's Designated Agent. Your Counter Notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled (for example, the URL).
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, mailing address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which Compozly may be found, and that you will accept service of process from the person who provided the DMCA notice or an agent of such person.
If Compozly receives a valid Counter Notification, Compozly may provide a copy to the original complaining party and may restore the removed material in accordance with applicable law.
6. Repeat Infringer Policy
Compozly maintains a repeat infringer policy consistent with the DMCA and our Terms of Service.
- Compozly may terminate the account of any user who is determined, in Compozly's sole discretion, to be a repeat infringer.
- For purposes of Compozly's policy, a "repeat infringer" generally includes a user for whom Compozly has received more than two DMCA takedown notices that comply with 17 U.S.C. § 512(c), or a user who otherwise repeatedly violates Compozly's intellectual property rules.
- Compozly may terminate accounts after a single notice in appropriate circumstances, including clear or egregious infringement.
7. Misrepresentations
Under the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. Compozly reserves the right to seek damages and other remedies against any party that submits notices or counter-notices in violation of applicable law.
8. Trademark and Other Intellectual Property Complaints
This Policy is primarily intended for copyright complaints under the DMCA. If you believe content violates your trademark or other rights, you may contact Compozly at legal@compozly.com with:
- Identification of the right you claim is being violated.
- Identification of the content and its location on the Service.
- Sufficient information for Compozly to evaluate the claim.
9. EU and International Illegal Content Reporting
Compozly supports reporting of allegedly illegal content for users located outside the United States, including in the European Union. If you believe content on the Service is illegal under applicable law, you may report it using Compozly's in-product reporting mechanism (where available) or by emailing legal@compozly.com with:
- The location of the content on the Service.
- A description of why the content is illegal.
- Your contact information.
Compozly may provide notice to affected users and may provide an explanation of content restrictions and removal decisions as required by applicable law.
